We may also disclose your data under the following circumstances: (i) to investigate, detect, prevent or take action regarding illegal activity or other wrongdoing; (ii) to assert or defend our legal rights; (iii) to protect our rights, property or personal safety and that of our users or the public; (iv) in the event of a change of control of us or one of our affiliates (by merger, acquisition or purchase of substantially all assets, etc.); (v) to collect, retain and/or manage your data through authorized third-party providers (e.g., cloud service providers), to the extent reasonably necessary for business purposes; (vi) to collaborate with third parties to improve your user experience. For the avoidance of doubt, we may at our discretion transfer or otherwise use non-personal data.

Please note that our services may enable social interactions (e.g., publicly posting content, information and comments and chatting with other users). Any content or data you provide in those areas may be read, collected and used by others. We advise against posting or sharing information you do not want made public. If you upload content to our digital assets or otherwise make it available in connection with using a service, you do so at your own risk. We cannot control the actions of other users or members of the public who have access to your data or content. You acknowledge and agree that copies of your data may remain retrievable from cached and archival pages or after third parties have copied/stored your content, even after deletion.

Cookies and similar technologies

When you visit or access our services, we authorize third parties to use web beacons, cookies, pixel tags, scripts and other technologies and analytics services (“tracking technologies”). These tracking technologies may enable third parties to automatically collect your data to improve navigation of our digital assets, optimize their performance and deliver a personalized user experience, as well as for security and fraud-prevention purposes.

Without your consent we will not share your email address or other personal data with advertising companies or ad networks.

We may serve advertisements through our services and digital assets (including websites and apps that employ our services) that may be tailored to you, for example ads based on your recent surfing behaviour on websites, devices or browsers.

To provide such advertising we may use cookies and/or JavaScript and/or web beacons (including transparent GIFs) and/or HTML5 local storage and/or other technologies. We may also engage third parties, such as ad networks (i.e., third parties that display ads based on your site visits), to deliver targeted advertising. External ad networks, advertisers, sponsors and/or services that measure website traffic may also use cookies and/or JavaScript and/or web beacons (including transparent GIFs) and/or Flash cookies and/or other technologies to measure ad effectiveness and tailor advertising content for you. These third-party cookies and other technologies are subject to the privacy policies of those third parties and not this policy.

Personal data may be maintained, processed and stored in the United States, Ireland, South Korea, Taiwan, Israel and, where necessary for the proper provision of our services and/or as required by law (as further explained below), in other jurisdictions.

Please note that we retain collected data for as long as reasonably necessary to provide our services, to comply with our legal and contractual obligations to you, to resolve disputes and to enforce our agreements.

We may correct, supplement or delete inaccurate or incomplete data at our discretion at any time.

How do we protect the data?

The hosting service for our digital assets provides the online platform through which we offer our services. Your data may be stored via the storage, databases and general applications of our hosting provider. It stores your data on secure servers behind a firewall and provides secure HTTPS access for most areas of its services.

All payment methods offered by us and our hosting provider for our digital assets comply with PCI-DSS (Payment Card Industry Data Security Standard) requirements of the PCI Security Standards Council (an organization representing brands such as Visa, MasterCard, American Express and Discover). PCI-DSS requirements help ensure the secure handling of credit card data (including physical, electronic and procedural safeguards) by our store and service providers.

Notwithstanding the measures and efforts taken by us and our hosting provider, we cannot and do not guarantee absolute protection or security of data you upload, publish or otherwise provide to us or others.

For this reason, we ask you to choose secure passwords and, where possible, not to disclose to us or others any confidential information the disclosure of which you believe could cause you substantial or lasting harm. Because email and instant messaging are not considered secure communications channels, we also request that you do not send confidential information via these channels.

How do we handle minors?

The services are not intended for users who have not reached the legal age of majority. We will not knowingly collect data from children. If you are not of legal age you should not download or use the services and should not provide us with any information.

We reserve the right to request proof of age at any time to verify whether minors are using our services. If we become aware that a minor is using our services, we may deny access to such users and block them, and we may delete any data we hold about such users. If you believe a minor has provided us with data, please contact us as described below.

Children may use our services. If they wish to access certain features, they may be required to provide certain information. The collection of some data (including data collected via cookies, web beacons and other similar technologies) may occur automatically. If we knowingly collect, use or disclose data from a child, we will notify and obtain parental consent in accordance with applicable law. We do not make a child’s participation in an online activity conditional on the child providing more contact information than is reasonably necessary to participate. We use data we collect only in connection with the services the child has requested.

We may also use a parent’s contact information to communicate about the child’s activities in the services. Parents may review the data we have collected from their child, prohibit further collection of their child’s data and request that all data we have collected about their child be deleted from our records.

Please contact us to view, update or delete your child’s data. To protect your child, we may request proof of your identity. We may deny access to data if we believe your identity is in question. Please note that certain data may not be deletable due to other legal obligations.

In providing the services we may transfer data cross-border to affiliates or other third parties and from your country/jurisdiction to other countries/jurisdictions worldwide. By using the services you consent to the transfer of your data outside the EEA.

If you are located in the EEA, we will only transfer your personal data to locations outside the EEA where we are satisfied that an adequate or comparable level of protection for personal data exists. We will take appropriate steps to ensure we have adequate contractual arrangements with our third parties to ensure that appropriate safeguards are in place to minimize the risk of unlawful use, alteration, deletion, loss or theft of your personal data and to ensure that those third parties act in accordance with applicable laws.

If you use the services as a resident of California, you may be entitled under the California Consumer Privacy Act (“CCPA”) to request access to and deletion of your data.

Category: Websites with a blog or forum
Users of the services who are residents of California and under 18 years of age may request removal of content they have posted by emailing the address listed under “Contact” below. Such requests must be clearly labeled “California Removal Request.” All requests must include a description of the content to be removed and sufficient information to enable us to locate the material. We do not accept requests that are not properly labeled or properly submitted, and we may be unable to respond if you do not provide sufficient information. Please note that your request does not guarantee complete or comprehensive removal of the material. Content you have posted may have been copied or reposted by other users or third parties.

Updates or changes to the privacy policy

We may revise this privacy policy from time to time in our discretion; the version posted on the website is always the current version (see the “Effective date” above). We encourage you to review this privacy policy periodically for changes. For material changes we will post a notice on our website. If you continue to use the services after being notified of changes, this will constitute your acknowledgement of and consent to the changes and your agreement to be bound by the revised policy.
